Terms and Conditions of the Online Store zbroia.com

  1. General Provisions

1.1. These Rules define the terms of use of the online store available at www.zbroia.com.

1.2. This Regulation is the regulation referred to in Article 8 of the Act on the Provision of Electronic Services.

1.3. The online store ZBROIA, operating at www.zbroia.com, is managed by PHU Yuliia Vedrenko, located at Marchołta 45-39, 31-416 Kraków, NIP: 9452290024, REGON: 528263618. Contact: market@zbroia.ua; phone: +48 453 283 931.

1.4. This Regulation specifies in particular:

– The rules for registering and using an account in the online store;

– The terms and conditions for placing Orders electronically in the Online Store;

– The rules for concluding Sales Agreements using services provided through the Online Store.

1.5. In accordance with applicable law, the ZBROIA Online Store reserves the right to limit the provision of services through the Online Store to persons over 18 years of age. Potential customers will be notified of the above.

  1. Definitions

The terms used in the Regulation mean:

2.1. Customer – a natural person, legal person, or organizational unit that is not a legal person, to which specific regulations grant legal capacity, who places an Order in the Store.

2.2. Consumer – according to Art. 22 [1] of the Civil Code – a natural person who performs a legal transaction with an entrepreneur not directly related to their business or professional activity.

2.3. Civil Code – the Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended).

2.4. Regulation – this Regulation for the provision of electronic services within the online store zbroia.com.

2.5. Online Store (Store) – an online service available at www.zbroia.com, through which the Customer can place Orders.

2.6. Goods – products presented in the Online Store.

2.7. Sales Agreement – a sales agreement for Goods within the meaning of the Civil Code, concluded between ZBROIA Online Store and the Customer, concluded using the Store’s website.

2.8. Order – a declaration of the Customer’s will aimed directly at concluding a Sales Agreement, specifying in particular the type and number of Goods.

  1. Order Placement

3.1. The Customer places an order for Goods through the service of the website zbroia.com.

3.2. During registration on the Online Store website, the Customer is obliged to provide the following registration information:

3.2.1. Customer’s surname and name;

3.2.2. Address for delivery of the Goods (if delivery to the Customer’s address);

3.2.3. Email address (optional);

3.2.4. Contact phone number.

3.3. The name, quantity, product code, and price of the Goods selected by the Customer are specified in the Customer’s basket on the Online Store website.

3.4. If additional information is needed, the Seller has the right to request it from the Customer. If the necessary information is not provided by the Customer, the Seller is not responsible for providing a quality service to the Customer during the purchase of goods from the online store.

3.5. Acceptance of the terms of this regulation by the Customer is done by entering the appropriate data in the registration form on the Online Store website.

3.6. The Customer is responsible for the accuracy of the information provided when placing an Order.

3.7. The sales contract between the Seller and the Customer is considered concluded at the moment of electronic order placement on the online store service or upon issuance of a cash or merchandise receipt or other document confirming payment for the Goods by the Seller to the Customer.

  1. Payment Methods

4.1. You can pay for your order depending on the Customer’s choice:

– Standard transfer to the Seller’s bank account;

– Payment by credit cards;

– Via the PayU payment platform;

– Cash on delivery, i.e., cash upon delivery of the goods to the Customer.

4.2. If the Customer chooses to pay in advance, the order must be paid within 7 working days from the date of placing the order.

4.3. The Seller informs that in the case of certain payment methods, due to their specificity, the payment for the order in this way is only possible immediately after placing the order.

4.4. By making purchases in the Store, the Customer agrees to the use of electronic invoices by the Seller. The Customer has the right to withdraw their consent.

  1. Order Fulfillment

5.1. The Seller is obliged to deliver the goods without defects.

5.2. The order execution date is indicated in the Store.

5.3. If the Customer has decided to pay for the order in advance, the Seller will start processing the order after receiving the payment.

5.4. Delivery is carried out both domestically and abroad.

5.5. The delivery of goods purchased in the Store is carried out depending on the delivery method chosen by the Customer:

– Via courier company.

5.6. The Customer can collect the goods personally at the Pick-up Point during its working hours.

  1. Returns/Exchanges

6.1. A Customer who has concluded a distance contract may withdraw from it without giving reasons and without costs, except for the costs specified in point 6 below, within 14 days from the date of receipt of the goods.

6.2. The Customer may withdraw from the contract within the period specified in the previous sentence by submitting a statement of withdrawal.

6.3. To meet the above deadline, it is also sufficient for the Customer to send a statement of withdrawal before its expiration.

6.4. In the event of withdrawal from the contract under the conditions set out above, the contract is considered void, and the Customer is released from any obligations. What the parties have provided is returned unchanged unless the change was necessary within the ordinary management framework. Together with the returned goods, the customer is obliged to return the goods received free of charge.

6.5. The Customer is responsible for any reduction in the value of the product resulting from its use beyond what is necessary to determine the nature, characteristics, and functioning of the product.

6.6. The Customer bears only the direct cost of returning the goods.

6.7. The Customer must provide the returned goods with a return form (the ready form is available on the website).

  1. Complaints Regarding the Provision of Electronic Services

7.1. The ZBROIA Online Store considers complaints in accordance with the current provisions of the Civil Code.

7.2. To file a complaint regarding the purchased product, please send the specified product along with the complaint form to the address of the company’s registered office: PHU Yuliia Vedrenko, ul Dobrego Pasterza 207, 31-416 Kraków, phone: 453283931, or notify the ZBROIA store by email about the problem for clarification of the discrepancy – zbroia.com.

7.3. The ZBROIA Online Store takes measures to ensure the full proper functioning of the Store to the extent resulting from the current technical knowledge and undertakes to remove any irregularities reported by Customers within a reasonable time.

7.4. The Customer is obliged to immediately notify the ZBROIA Online Store about any irregularities or interruptions in the functioning of the Online Store website.

7.5. The Customer may report malfunctions of the store to the email address: market@zbroia.ua.

7.6. In the complaint, the Customer should indicate their name and surname, correspondence address, type, and date of the occurrence of the irregularity related to the product/work of the store.

7.7. The online store zbroia.ua undertakes to consider each complaint within 14 days. Failure to consider a complaint within the aforementioned period means that it will be considered justified.

  1. Liability of the Parties

8.1. The Seller is not responsible for damages caused to the Customer as a result of improper use of the Goods previously ordered on the ZBROIA website and purchased from the Seller.

8.2. The Seller is not responsible for improper or untimely execution of Orders and obligations in case of providing inaccurate or false information by the Customer.

8.3. The Seller and the Customer are responsible for fulfilling their obligations in accordance with applicable law and the provisions of this Regulation.
